Hamilton has acted for AGA in connection with a procurement regarding gases and liquefied petroleum gas, conducted by the municipality of Uddevalla. AGA’s bid was not qualified in the procurement and AGA submitted a review application to the Göteborg Administrative Court. AGA argued, inter alia, that the requirement which AGA was considered not to have fulfilled was in breach of the principle of transparency and the prohibition of referring to a specific brand. After the administrative court rejected AGA’s review application, AGA’s appeal was approved by the Göteborg Administrative Court of Appeal. The municipality will now conduct a new procurement.
